KOTA KINABALU: A real estate agent broke into tears and knelt on the floor when the High Court acquitted him of a drug trafficking charge.
Norain Lamilah, 55, was charged with trafficking in 1,387.86 grammes of drugs in the Customs office here about 11.50am on Nov 28 last year.
He was charged under Section 39B (1)(a) of the Dangerous Drugs Act 1952 which provides a mandatory death sentence upon conviction.
Deputy Public Prosecutor Nazir Amir Johari appeared for the Royal Malaysian Customs department before Judge Datuk Nurchaya Arshad who ordered Norain’s release.
On that day, Norain had approached a Customs officer to inquire on the tax amount regarding a parcel, purportedly belonging to his friend, who was in Indonesia.
Further examination revealed dangerous drugs in a secret compartment inside a red trolley bag and chemical analysis confirmed the substance to be methylenedioxymethamphetamine.
His counsel Datuk Seri Rakhbir Singh told reporters outside the court that they had submitted a representation to drop the charge.
“We asked for the charge to be withdrawn as the accused did not possess the drug or have knowledge of the contents of the parcel. Besides he was not the recipient,” he said.
