KOTA KINABALU: Datuk Dr Yusof Yacob remains as Sindumin assemblyman.
Sabah Legislative Assembly speaker Datuk Kadzim Yahya said the seat did not fall vacant despite the elected representative quitting Parti Warisan Sabah (Warisan) on Oct 8.
On the same day, the independent lawmaker, who now supports Gabungan Rakyat Sabah, had requested a meeting with the speaker.
During the meeting, Dr Yusof had submitted a statutory declaration, declaring inter-alia, that he was revoking all the pledges he has made with Warisan before the 16th general elections in 2020 took place, including if any, a pledge to vacate the Sindumin seat should he leave the party.
As for a document from a legal firm dated Oct 15 indicating Dr Yusof was resigning, Kadzim denied he had appointed the firm nor signed a resignation letter dated Oct 8.
"Datuk Dr Yusof Yacob submitted another statutory declaration dated 16th October 2021, declaring inter-alia, that he had never signed the purported resignation letter dated 8.10.2021 as submitted by the legal firm and that he had resigned his seat N.35 Sindumin via the resignation letter," he said in a statement.
Kadzim added he had received three documents from Dr Yusof and two documents from Warisan.
"To determine the status of the seat N.35 Sindumin, I am guided by the documents that had been submitted to me above, the meeting conducted on the 11 October 2021, the law as it now stands and the case of Sebatik assemblyman which is similar in facts with the issue now at hand.
"Therefore, Datuk Dr Yusof Yacob is still the assemblyman for the State seat N.35 Sindumin."
