Sabah moves to speed up issuance of subsidiary property titles

KOTA KINABALU: Sabah state government has taken proactive steps to accelerate the implementation of subsidiary titles in property ownership.

Datuk Seri Wilfred Madius Tangau (Upko–Tamparuli) said the proposed Land (Subsidiary Title) Enactment 2026 ensures homeowners are entitled to ownership that is legally certain, clear and secure.

He added that the number of strata developments is increasing year by year, but the management of subsidiary titles has not progressed at the same pace.

"Imagine a homebuyer who pays a deposit, consistently services monthly instalments, and raises children in that home. Yet legally, still does not have full ownership rights," he said when debating the bill at the state legislative assembly here.

Parti Gagasan Rakyat Sabah secretary-general Datuk Mohamed Razali Mohamed Razi, an appointed assemblyman, said that with the large-scale migration of people from rural areas to major growth centres such as Kota Kinabalu, Penampang, Sandakan and Tawau, available land is becoming increasingly scarce.

"We no longer have the luxury of allowing scattered development patterns or urban sprawl, where housing projects consume thousands of acres of green areas and agricultural land.

"The future of our urban planning lies in vertical development. We must build upwards," he said, adding that the lifestyle shift requires a modern, efficient and integrated land administration framework.

He added that the Bill modernises the workflow between developers, licensed land surveyors, local authorities and the Department of Lands and Surveys.

"More importantly, the efficiency of issuing strata titles is directly linked to the state's spatial planning.

"By promoting systematically managed strata development, we are also protecting our forests, water catchment areas, and agricultural land on the urban fringes from excessive exploitation."

The Bill was tabled by Sabah Assistant Minister to the Chief Minister Datuk Isnin Aliasnih.
