Tawau syariah court first to carry out caning.

KOTA KINABALU: The Tawau Syariah Court was the first to implement public caning in the country. 
State Syariah Chief Judge Datuk Jasri@ Nasip Matjakir said one such punishment involving two offenders was carried out by the Syariah court in 2016.
He was clarifying Kelantan Syariah court chief judge Datuk Daud Muhammad who said Kelantan would be the first in the country to undertake such punishment.
This follows the state's passing of amendments to its Kelantan Syariah Criminal Procedure Enactment 2012, allowing for syariah offenders to be caned in public. 
Jasri said a man and a woman were caned six times each at Tawau Civil court in 2016 for committing adultery.
“The civil court was used for the caning sentence as coincidentally there was a (Syariah-related) seminar at that time(to provide an example).
“The caning was held and witnessed by participants of the seminar,” Jasri said when asked about a footage of the caning dated Nov 28, 2016 which was uploaded in Youtube channel in March.
He was speaking to reporters after the commissioning of 16 Syariah lawyers at Wisma Muis here yesterday.
Jasri added the leak of the video helped the government to explain Syariah punishment meant to educate the people.

The footage of approximately 5-minute duration showed medical officers certifying offenders were fit to undergo punishment before it was implemented.

Another sentence in Tawau court in 2014 was postponed as the woman offender was certified by a medical officer to be pregnant.
The accused was sentenced under Section 80 (2) of Syariah Criminal Offences Enactment 1995 for forbidden sexual intercourse.
The offence carries a fine not exceeding RM5,000,  imprisonment for a term not exceeding three years, or maximum caning of six strokes.
